PROHIBITION OF CERTAIN AGREEMENTS BETWEEN PHARMACISTS AND MEMBERS OF CERTAIN PROFESSIONS

It is forbidden for anyone practicing a medical profession to receive, in any form whatsoever, directly or indirectly, interest or rebates proportional or not to the number of units prescribed or sold, whether it concerns medicines, orthopedic appliances, or other products of any kind.
The formation and operation of companies whose purpose is the pursuit of the interests defined above and which belong to the individuals themselves or the group formed for this purpose, as well as the exercise of the profession of pharmacist for the same purpose, is prohibited.
The offenses referred to above are punishable by a fine of between 200,000Frs and 1,000,000Frs and imprisonment of six days to six months, or one of these two penalties only. The pharmacist who is a co-perpetrator of the offense shall be liable to the same penalties. In the event of a repeat offense, the above-mentioned fine varies from 1,000,000 to 2,000,000 F and a temporary ban on practicing the profession for one year is imposed. A temporary ban on practicing the profession for a period of one to ten years may be imposed by the court in addition to the main penalty.
